Model law on military discipline

Abstract

The objective of this research was to establish a model law on military disciplinary in compliance with the Constitution of the Kingdom of Thailand B.E. 2560 and International public law. The data collection and analysis for this research was qualitative research consisting of documentary research; in -depth interview; participatory- design, co – design; and hearing. The research results found that the scope of duties and powers of the military had been further developed from the original according to the Constitution of the Kingdom of Thailand B.E. 2560, but soldiers still lack of the protection of human dignity and fundamental rights under the principles of public international law causing the Military Discipline Act B.E. 2476 to be out of date The research repeal this law and created a new model law on military discipline. The legal structure were military ethics, Military Discipline, Military Disciplinary Proceedings, Military Disciplinary Committee, Appeals, Prosecutions; and Transitional provisions. The research recommends that this bill present to the Parliament for enactment as an applicable law and the Military Court established Military disciplinary division in the Military Court.
