การกระจายอำนาจภายใต้การบังคับใช้กฎหมายและข้อบังคับในนโยบายการควบคุมเครื่องดื่มแอลกอฮอล์ ทั้งในระดับชาติและท้องถิ่น

บทคัดย่อ
บทความวิจัยฉบับนี้มีวัตถุประสงค์ คือ เพื่อวิเคราะห์ถึงการกระจายอำนาจและการบังคับใช้กฎหมายและข้อบังคับในนโยบายการควบคุมเครื่องดื่มแอลกอฮอล์ทั้งในระดับชาติและท้องถิ่น ผู้วิจัยใช้ระเบียบวิธีวิจัยเชิงคุณภาพประกอบด้วยการวิจัยเอกสารและการสัมภาษณ์แบบเจาะลึก จากกลุ่มตัวอย่างได้แก่ 1) เจ้าหน้าที่ภาครัฐ 2) ภาคประชาชน และ 3) ภาคธุรกิจ ผลการวิจัยแบ่งออกเป็น 3 ประเด็น คือ 1) กฎหมายและข้อบังคับด้านการควบคุมเครื่องดื่มแอลกอฮอล์จากระดับชาติถึงท้องถิ่น ซึ่งปัจจุบันมีคณะกรรมการนโยบายเครื่องดื่มแอลกอฮอล์แห่งชาติ คณะกรรมการควบคุมเครื่องดื่มแอลกอฮอล์ และคณะกรรมการควบคุมเครื่องดื่มแอลกอฮอล์จังหวัด ดำเนินการภายใต้ฐานคิดการควบคุมและสั่งการจากอำนาจรัฐผ่านตัวเจ้าหน้าที่รัฐเป็นสำคัญ ทั้งนี้ มีสัดส่วนของการมีส่วนร่วมของภาคีเครือข่ายภาคประชาชนถูกลดทอนโดยอำนาจรัฐผ่านการจัดคณะทำงานผ่านตำแหน่งข้าราชการที่เกี่ยวข้อง 2) การทำงานร่วมกันระหว่างท้องถิ่นกับหน่วยงานส่วนกลางของรัฐในด้านการควบคุมเครื่องดื่มแอลกอฮอล์ สะท้อนภาพลักษณะของการสั่งการและลักษณะของการขอความร่วมมือ และ
3) หลักการกระจายอำนาจประเด็นกฎหมายและนโยบายที่เกี่ยวข้องกับเครื่องดื่มแอลกอฮอล์ กล่าวคือ ควรกระจายอำนาจและลดบทบาทการรวมศูนย์ในเชิงนโยบายเปิดโอกาสให้ท้องถิ่นได้กระทำการในประเด็นเรื่องแอลกอฮอล์อย่างอิสระ
