Problem of Air Pollution and Concept for Drafting Law to Amend Air Pollution

This research aims to study and compare the air pollution management of State agencies. Pollution Control Officers and Competent Officials have the specific power and duty to take legal enforcement measures against the owner or possessor of the source of pollution. This research will study and suggest concepts for drafting a model law to remedy air pollution and specifying the authorities and duties of the Air Pollution Management Committee in issuing by-laws, rules, and regulations to state agencies, pollution control officers, and officials to be used as a measure to check, control, prevent, reduce, and eliminate air pollution in the country. This research shall apply qualitative research methods, including documentary research, in-depth interviews, and listening to opinions.
The results of the study found that the causes of problems and obstacles in air pollution control by State agencies, Pollution Control Officers, and Competent Officials appear in the Improvement and Conservation of the National Environmental Quality Act B.E. 2535 (1992), and other environmental laws have not yet clearly provided air pollution management. As a result, officials' operation in controlling air pollution is delayed. When compared with the air pollution control processes of foreign laws, it becomes evident that foreign laws assign specific powers and duties to state agencies. Pollution Control Officers and Competent Officials enforce the law against owners or occupiers of air pollution sources. However, Thai law has not yet defined the authority and duties of State agencies, Pollution Control Officers, and Competent Officials to Manage Air Pollution. This research, therefore, forms the framework of the model law on solving air pollution to be a legal concept in determining the authorities and duties of the Air Pollution Management Committee to enact subordinate legislation to solve problems with efficiency comparable to foreign laws.
This research has academic recommendations to use the drafted model law as a provision providing the authorities and duties of the Officials to solve air pollution problems that occur in the local area. Implementing this recommendation may help solve the problem of air pollution more efficiently and effectively. Additionally, it can foster methods of participation between people and the State in legal, social, and economic aspects. It allows for joint air pollution management between the public sector and the private sector, which shall lead to national development along with the evolution of environmental laws in a unified manner, and it shall solve problems together, which will bring benefits to the public.
