Abstract

Currently, Thailand is facing an epidemic of coronavirus disease 2019 (COVID-19), causing people to buy and sell consumer products, including modern drugs via online platforms to avoid touch and provide convenient and quick services. A review of the literature reveals that the distribution of modern drugs via online platforms in Thailand has not been prohibited due to the restrictions under the Drug Act B.E. 2510 and the ministerial regulation on the application for permission and issuance of a license to sell modern drugs B.E. 2556.

Accordingly, this independent study aims to examine the legal problems surrounding the distribution of modern medicine via online platforms in Thailand and analyze how additional legal criteria should be established by conducting a comparative study of foreign laws with a particular focus on the United States and India. The study then proposes guidelines for corrections, criteria for improvement, and laws regarding the online-platform distribution of modern medicine in Thailand.
