Observation in Formulating Act to Transform State University into Autonomous University

Abstract

This paper aims at presenting principles and basic concepts in formulating act to transform state university into autonomous university. The main idea is to change university status from bureaucracy to non-bureaucratic organization by laws including; Government Administration Act; Ministry of Higher Education, Science, Research and Technology’s Administration Act; and laws in transforming ministry, bureau, department and non-state enterprise following budget procedures and other laws The changes facilitate better administration in human resource, finance, education and quality assurance monitored by university councils and minister for Higher Education, Science, Research and Technology. In formulating the act, it is important to proceed correctly with regulation, process, and method that article no. 77 of the constitution of Thailand, and legislation and legal evaluation act B.E. 2562, State Fiscal and Financial Disciplines Act B.E.2561, royal property act B.E. 2562, and related subsidiary legislation. In addition, the content preparation, in the act regarding roles and function of the university after changing its status, must consider the coherence with state’s policy, national strategy, reformation plan, national plan on higher education and human resource development plan, national plan on science, research and innovation, and framework on State Fiscal and Financial Disciplines. Moreover, it must consider education management cost, opportunity, equal accessibility to education for learners, and welfare of officials, university officers and university employees whom may affect from the change. These principles would regulate the act in accordance with the general principle for state university and also allow the autonomous university decide and contextualise its own development direction effectively, ready to change, and capable to sustainability in human resource development.
