Improvement of law hierarchy to support missing person finding operation and unclaimed and unidentified body identification process in Thailand

Abstract

The increasing incidence of missing person in Thailand over the past few years indicates that improvement in measures and operating procedures of finding the missing is utterly needed. The personnel responsible for registering the missing report must be vigilant to not only the possibility of adverse events that might happen to the individual reported but also any unusual behavioral and psychosocial factors that could be the clue to disappearance because in the case of crime the person reported to be missing may be later found dead from murder. According to the Regulations of the Office of the Prime Minister to provide support of missing person finding operation and identification of unclaimed and unidentified bodies, 2564. However the aforementioned regulations are considered as the subordinate legislation in the hierarchy of law which can never be contradicted to the law of higher hierarchy, i.e. an act, so some activities and processes that required mutual cooperation from other disciplines and organizations are inevitably delayed or even restricted by law which in turn resulting in unpunctual operation and disadvantages to the person or victim. Improvement of the missing person-related law hierarchy to ease up the operating process may bring about positive impact to overall justice, system integration efficiency, opportunities to reach the judicial process which in turns increases reliability and endorsement of the organization by the public.
