The Proper Penalty for the Absence of the Duty to Rescue: a Study on Article 374 of the Criminal Code

Abstract
This article presents the feasibility study of penalty for persons who do not act in good citizenship. By considering the balance between (i) right, liberty and (ii) moral duties, legal interventions that affect the need for the state to impose moral duties for everyone in the society to act as good citizens, with compassion for helping human friends those who have been harmed to life or body including having to act as a state aid in the care of life or body safety in accordance with public order. By using criminal compulsory measures in determining the omission of good citizenship as a criminal offense having penalties that affect the right, liberty and decision of individuals in their lives. This study is aimed to analyze and interpret the provisions on article 374 of the Penal Code, to find out the intention of the provisions of the law in order to provide legal enforcement approximately and efficiently.
