Legal Poblems Regarding Procurement and Supplies Administration of Thai Government Agencies Located Abroad According to The Law on Public Procurement and Supplies Administration

Abstract

        This academic article studies the legal issues associated with the procurement and supply processes of Thai government agencies in foreign countries, governed by the Public Procurement and Supply Administration Act, B.E. 2560 (2017). It focuses on studying and analyzing issues related to the procurement and supply of Thai government agencies in foreign countries and studying concepts and theories related to the procurement of government supply. Additionally, it suggests a solution that follows this act and aligns with the principles of procurement, which are value for money, transparency, efficiency, effectiveness, and accountability, in compliance with the spirit of the law.

          According to the research, this act has issues regarding the procurement and supply of Thai government agencies in foreign countries. These issues include the focal price of Thai government agencies in foreign countries, the detection and prevention of corruption, and the flexibility in enforcing the Public Procurement and Supply Administration Act, B.E. 2560 (2017) with Thai government agencies in foreign countries that results in a lack of value for money, transparency, efficiency, effectiveness, and accountability for Thai government agencies in foreign countries.

           Therefore, the author suggests revising this act by having the Comptroller-General's Department create a database of focal prices of countries worldwide to assist Thai government agencies in foreign countries in searching as a reference for a resource of focal prices. Additionally, the author proposes amending provisions to authorize government agencies to issue regulations regarding procurement and supply management by themselves. The author also views it as proper for the Ministry of Finance to issue centralized regulations governing the procurement and supply of Thai government agencies in foreign countries to ensure adherence to consistent guidelines.
