LEGAL PROBLEMS RELATED TO THE HOUSING ESTATE BUSINESS

Abstract
The purposes of this study were: 1) to Study the history, concepts, theories, and laws regarding the housing business, 2) to Study legal measures regarding the housing development business in Thailand and abroad, 3) Trouble with legal problems regarding the housing business and (4) to find ways to resolve legal issues regarding the housing business. The study was quantitative research.
The research format is used primarily by document research in research by gathering information from all relevant documents. To analyze legal problems regarding the housing business.
The results of the research found that:
study found problems arising from the enforcement of The Land Appropriation Act B.E. 2543 affecting housing buyers as follows.
1) Section 29 deals with the advertisement of land allocation projects cannot provide protection to buyers of housing estates. Also, the penalties under Section 61 are not appropriate to enforce.
2) Section 53 There is no systematic process for collecting common fees, resulting in insufficient funds for the management of housing estates.
3) The law does not contain provisions regarding the transfer of ownership in housing estates that require a debt-free certificate. As a result, housing buyers do not know that there is a debt owed to the juristic person.
