Efficiency of Enforcement of the Mediation Act B.E. 2562 at the Investigation Level

Abstract
The purpose of this research was to study the problems and obstacles of the enforcement of the Mediation Act B.E. 2019 at the investigation level. Study on guidelines for adding offenses in criminal cases to the criminal case mediation process at the investigation level and proposed guidelines for enhancing the efficiency of the enforcement of the Mediation Act B.E. 2562 at the investigation level. The results of the research can be used to increase the efficiency of the enforcement of the Mediation Act B.E. 2562 at the investigation level is as follows: set a policy for each police station to conduct mediation cases, this law must be strictly implemented, set as indicators in the strategic plan of the police. Make a step-by-step guideline. Set up a permanent working group of police stations that perform specific functions. There is a mediation room. Get a dedicated mediation case number. Shorten the mediation process. Assigning specialized investigators to conduct mediate cases, organize mediators at various police stations, appoint community leaders or respectable people in society as mediators. Training to educate police officers at 3 levels: executive level, supervisor level, investigative officers. There is an online mediation system. Increase budget, increasing publicity to the general public about their rights and procedures for entering into the mediation process. Motivate investigators to implement this law seriously.
The results of this research were to gain the new knowledge for the Royal Thai Police to determine a policy to establish a mediation center for civil disputes at the police station with 3 phases: Phase 1: establishment of 18 pilot police stations in the Metropolitan Police Headquarters, selected 2 the pilot station (Bok. 1-9) for each station. Phase 2: establishment of 78 pilot police stations in the Provincial Police Regions 1-9, with selection of one pilot police station per province (determining police stations in different cities). Phase 3: establishment of police stations nationwide. The Royal Thai Police has currently completed all 3 phases on March 31, 2023.
