The Presentence Investigation in the Criminal Justice Process

Abstract

The purpose of this article is to examine the Criminal Justice process issues in the fact finding of criminal or the presentence investigation, which could lead to propose the guideline of the presentence investigation bringing the fairness to trial. From the review of the concepts and theory in criminology for an appropriate sentence and rehabilitations conduce towards a recommendation for developing the presentence investigation, which includes a recommendation for law amendment that the presentence investigation should be addressed in any criminal cases following the principles of justice in determining the penalty. Second, a recommendation on criminal justice policy that should utilize technology to collect offender’s data and forward information to agencies in the justice system for the purpose of individual rehabilitation. Lastly, a recommendation on academic studies is to take advantages of the report and to consider alternatives to Imprisonment or division of criminal cases from the criminal justice system for an unraveling the crisis of the overcrowding issue in prison.
