The Stipulation of Criminal Liability: A Study of Appropriate Offenses Relating to Public Service Fraud in Thailand

Abstract
Since the Penal Code was promulgated, there has not been any amendment to stipulate public service fraud as an offense in Chapter 3, Offenses of Cheating and Fraud. The act of public service fraud is not criminally offendable in some cases, but is merely a breach of civil contract because court decisions and lawyers’ academic opinions coincidently view that the public service is not property. However, current social conditions immensely change, meanwhile, the supply of public services have rapidly increased in response to the needs of society and individuals related to critical public utilities, such as electricity, water supply and telecommunication. As a result, means of fraud have also vastly changed and a number of public service frauds have arisen. Such public service frauds, actually, deserve condemnation and punishment by law in equivalent to property fraud of other cases. It is a form of economic crime that causes immense economic and social damages. The Penal Code being currently in force has still had a gap and is not applicable to take legal action to punish offender inclusively and efficiently. Even though certain specific acts are applicable to punish and solve problems in relation to the provision of public services in some cases, their enforcement still lacks efficiency. Accordingly, such specific acts should be revised to cover more offendable acts and stipulate the public service fraud in an appropriate manner as an offense in the Penal Code for more efficient enforcement and the compliance with current circumstances.
