Study of Guidelines for Developing Laws Related to Online Trading

Abstract
The objectives of this research study were to 1) examine the issues, concepts, theories, and laws related to online trade, and 2) draw conclusions and propose recommendations for the amendment of laws related to online trade in Thailand. qualitative research methods, with documentary research, in-depth interviews, and focus group discussions with legal experts who have at least 5 years. The research results found that the problems related to online shopping are: 1) issues regarding consumer protection measures in online trade, the Consumer Protection Act B.E. 2522 (1979) does not contain specific provisions for consumer protection in online shopping, and 2) issues related to penalties for violations of consumer protection measures in online trade, In the case where a seller deceives consumers, Additionally, It is a light penalty that cannot prevent or deter offenders. The proposed recommendations included amending the Consumer Protection Act B.E. 2522 (1979) by adding Section 4 on Consumer Protection in Online Trade to Chapter 2 on Consumer Protection. Moreover, a penalty provision in Section 47 should be added stating that if an advertisement or label contains false information, the penalty shall be imprisonment for not more than 1 year, a fine of up to 300,000 baht, or both imprisonment and a fine. If the offender repeats the offense, the penalty shall be imprisonment for 2-5 years, a fine of 200,000-500,000 baht, or both. Additionally, a penalty provision in Section 61/1 should be added stating that if a seller fails to register, the penalty shall be imprisonment for not more than 1 year, a fine of up to 300,000 baht, or both. If the offender repeats the offense, the penalty shall be imprisonment for 2-5 years, a fine of 200,000-500,000 baht, or both.
