Environmental Crime Prevention: A Case Study of Air Pollution Impact in Map Ta Phut Industrial Estate

Abstract

This study emphasized on the causes, factors resulting in air pollution problems in Map Ta Phut Industrial Estate. The findings will lead to the proposed measures for prevention and environmental crime resolution and the overall perspective on the judgement process in solving air pollution problems. The data was collected from the document and in-depth interviews, carried out on 6 specific sample groups with 24 informants including the group of people in Map Ta Phut municipality, leaders and representatives of the communities surrounding Map Ta Phut Industrial Estate, government agencies and state enterprises, independent scholars, non-governmental organizations (NGOs) and criminal justice personnel.


The findings revealed as follows: 1) causes and factors causing air pollution in Map Ta Phut Industrial Estate area resulting in problematic management by government agencies, air quality management, and law enforcement and penalties’ problems 2) environmental crime prevention and solution consisted of 5 approaches as: (1) strictly controlling the volatile organic compound emission (2) setting standards of and monitoring organic compound volatileness (3) assessing the potential for air pollution support by mathematical models (4) connecting data at the air quality monitoring network level in the Map Ta Phut area, and (5) supporting the people to participate in the process of solving air pollution problems and 3) for overall perspective on the judgement process in solving air pollution problems, it was found that the mechanisms of judgement process cannot solve the environmental crimes effectively since officials are not able to handle air pollution problems comprehensively or neglect to perform their duties. Moreover, entrepreneurs and related agencies do not disclose or distort information. Additionally, legal measures implemented to control or discharge air pollutants from factories do not reflect the facts. Therefore, environmental laws should be revised and integrated to ensure clear enforcement operation and penalties in conjunction with promoting environmental awareness among industrial factories.
