LEGAL PROBLEMS IN INVESTIGATION AND COMPARING ACCORDING TO SECTION 60 OF THE LAND CODE

Abstract

This research has four objectives as follows: 1) To study the background, concept, theory, and importance of investigation and comparing according to Section 60 of the Land Code; 2) To study on the Thai laws and foreign laws, criteria, method, and conditions related to investigation and comparing; 3) To study and analyze on the problems of investigation and comparing; 4) To search for guidelines to solve problems relating with investigation and comparing.        

            The finding from this research:

            it is that investigation and comparing under Section 60 of the Land Code have problems and unclearness in implementation including the scope of investigation and comparing which there is no giving of meaning of investigation and comparing, the period of investigation and comparing which is not suitable and there is no determining of qualifications of land officer who investigates and compares clearly.

The recommendation of this research, there should be recommendation additionally be determining the meaning of investigation and comparing clearly, specifying the time for implementation, specifying the qualifications of land officers in the investigation and comparing process to have suitability and clearness increasingly.
