บทคัดย่อ
บทความนี้ อธิบายประเด็นปัญหาและกระบวนการพัฒนาของการบังคับใช้กฎหมายของศาลปกครองในสหภาพยุโรปและกรณีศึกษาศาลปกครองในประเทศฝรั่งเศสและเยอรมนี โดยปัญหาการบังคับใช้กฎหมายของศาลปกครองในสหภาพยุโรป ฝรั่งเศส และเยอรมนีมีความซับซ้อนในด้านการตีความและความขัดแย้งกับกฎหมายภายในประเทศ ในสหภาพยุโรปการบังคับใช้กฎหมายต้องพิจารณาความสอดคล้องกับกฎหมายของสหภาพ ในฝรั่งเศสศาลปกครองมีความเข้มงวดในการควบคุมอำนาจของฝ่ายบริหาร ขณะที่ในเยอรมนี ระบบศาลเน้นการคุ้มครองสิทธิของพลเมืองและการปฏิบัติตามกฎหมายรัฐธรรมนูญอย่างเคร่งครัด ในส่วนของกระบวนการพัฒนาการบังคับใช้กฎหมายของศาลปกครองในสหภาพยุโรป ฝรั่งเศส และเยอรมนีแสดงให้เห็นถึงแนวโน้มที่เน้นความโปร่งใสและประสิทธิภาพมากขึ้น ในสหภาพยุโรป ศาลปกครองมีบทบาทสำคัญในการรับรองความสอดคล้องของกฎหมายระดับชาติและกฎหมายสหภาพ โดยเฉพาะด้านสิทธิมนุษยชนและตลาดร่วม ประเทศฝรั่งเศสมีการพัฒนาบทบาทศาลปกครองให้เข้มแข็งขึ้นในการตรวจสอบการใช้อำนาจของรัฐ ขณะที่ประเทศเยอรมนีมุ่งเน้นการพัฒนากระบวนการยุติธรรมที่คุ้มครองสิทธิเสรีภาพของประชาชนและปฏิบัติตามหลักกฎหมายรัฐธรรมนูญ ศาลในประเทศฝรั่งเศสและเยอรมนีมีการปรับปรุงอย่างต่อเนื่องเพื่อตอบสนองต่อการเปลี่ยนแปลงทางสังคมและการเมือง
