LEGAL MEASURES WITH REGARD TO INTELLECTUAL PROPERTY PROTECTION: CASE STUDY OF PATENT WITH LOCAL WISDOM IN MUANG DISTRICT, CHANTHABURI PROVINCE

Abstract
This research aims ,firstly, to study the current condition, the desirable condition of the patent registration and the knowledge and understanding of the community towards intellectual property law and, secondly, to present legal measures for the protection of intellectual property focusing on bringing the local wisdom in Chanthaburi province for patent registration. The methodology for conducting this research was a mixed methods research between quantitative and qualitative research. The sample population consisted of 50 residents in Muang District, Chanthaburi Province, selected by a quota random sampling. The researcher studies documents and textbooks related to intellectual property law on patents. Also, selected experts and stakeholders were interviewed, which were two stakeholders on patents registration, two intellectual property law experts, and 11 local community leaders with local wisdom knowledge. The results were analyzed using the Analytic Induction method and presented in tabular data and analytical descriptive data.
The results of the study showed that stakeholders involved with local wisdom and related agencies have a proper knowledge and understanding of intellectual property protection laws, especially, on patents. On the other hand, though residents have basic knowledge of intellectual property law, especially on granting patents for product inventions and geographic indications, misunderstandings of the types of intellectual property and the conditions of patent coverage are still problems. Furthermore, suggested improvement on the legal measures for the protection of intellectual property focusing on bringing the local wisdom are as follows 1) the enactment on intellectual property in respect of local wisdom particularly, 2) the amendment of intellectual property law in the matter of patents, 3) the adaption of the Philippine legal approach, where a state shall guarantee and protect local wisdom, without the need to rely on the principles of creativity or registration, 4) the practical applications of legal knowledge on principles related to legal measures for the protection of intellectual property and 5) the measures to increase the efficiency of patent registration to promote innovation and intelligence driven on the local wisdom.
