Abstract

Introduction: Aquatic resources are an essential food source for the world’s population, as they provide a major source of protein. They are also relatively accessible and can be naturally replenished. However, although aquatic resources are renewable by nature, a lack of appropriate management in their utilization can lead to serious problems. Objective: to study the problems of fishing areas in the seas of other states according to the 1982 United Nations Convention on the Law of the Sea. Methods: qualitative research by documentary research methodology. Results: 1) In enacting laws and regulations on fishing in the exclusive economic zone, which is the jurisdiction of coastal states, Article 73, paragraph 1 of the United Nations Convention on the Law of the Sea, 1982, should establish measures to control fishing vessels of other states that sail through their exclusive economic zone, such measures must not conflict with the navigation rights of other states. Especially in overlapping areas, it should be made into a bilateral treaty for mutual benefit with limitations. 2) The exercise of the rights of other states to sail in the exclusive economic zone, in this case, international cooperation may be used to reach an agreement or make a treaty between them, so as not to conflict with the freedom of navigation. 3) Enacting rules and regulations on controlling fishing in the exclusive economic zone, states with great capacity can reach bilateral agreements with coastal states with limited capacity, so that the coastal state allows them to enter and fish in the exclusive economic zone by granting concessions or issuing licenses, in accordance with the laws and regulations of the coastal state. By comparing international fishing cases with local cases.
