มาตรการทางกฎหมายในการส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุ

บทคัดย่อ
บทนำ: ประเทศไทยได้เริ่มให้ความสำคัญกับการส่งเสริมสุขภาวะทางจิตและอารมณ์ของผู้ต้องขังในเรือนจำ เพื่อให้มีความสอดคล้องกับข้อกำหนดมาตรฐานขั้นต่ำของสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขัง (ข้อกำหนดแมนเดลา - Mandela Rules) และพระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 แต่ยังไม่มีมาตรการทางกฎหมายให้ความคุ้มครองอย่างเหมาะสม วัตถุประสงค์ของการวิจัย: 1) เพื่อศึกษาแนวคิด และทฤษฎีเกี่ยวกับการบังคับโทษจำคุก รวมถึงแนวทางในการส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุ 2) เพื่อวิเคราะห์ถึงปัญหาทางกฎหมายเกี่ยวกับการส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุในประเทศไทยเปรียบเทียบกับต่างประเทศ 3) เพื่อทราบแนวทางปรับปรุงการส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุให้เกิดความเหมาะสมสอดคล้องกับข้อกำหนดมาตรฐานขั้นต่ำระหว่างประเทศ ระเบียบวิธีวิจัย: เป็นวิจัยเชิงคุณภาพ ศึกษากฎหมายที่เกี่ยวข้องกับการส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุของไทย โดยเปรียบเทียบกับกฎหมายส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุของสหรัฐอเมริกา ญี่ปุ่น และเครือรัฐออสเตรเลีย ผลการวิจัย: พบว่า แนวทางและมาตรการทางกฎหมายของไทยที่กรมราชทัณฑ์บังคับใช้ยังให้ความคุ้มครองและส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุไม่เพียงพอ มาตรการด้านการดูแลรักษาพยาบาลและการดูแลสุขอนามัยและสิ่งแวดล้อมยังไม่เหมาะสมต่อผู้ต้องขังสูงอายุ ไม่ได้แยกกิจกรรมให้เหมาะสมกับผู้ต้องขังสูงอายุ และยังไม่มีการบัญญัติกฎหมายเกี่ยวกับการแก้ไขฟื้นฟูผู้ต้องขังสูงอายุไว้โดยเฉพาะ สรุป: ประเทศไทยควรกำหนดแนวทางและมาตรการทางกฎหมายในการส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุ ให้สอดคล้องกับมาตรการทางกฎหมายของสหรัฐอเมริกา ญี่ปุ่น และเครือรัฐออสเตรเลีย เพื่อส่งเสริมสุขภาวะทางจิตและอารมณ์ผู้ต้องขังสูงอายุของประเทศไทยต่อไป
