มาตรการทางกฎหมายในการมีส่วนร่วมของชุมชนเพื่อการสงเคราะห์ และเฝ้าระวังการกระทำผิดซ้ำ

บทคัดย่อ
บทนำ: ประเทศไทยเผชิญกับปัญหาการกระทำผิดซ้ำในความผิดเกี่ยวกับเพศหรือที่ใช้ความรุนแรง จึงมีการตราพระราชบัญญัติมาตรการป้องกันการกระทำความผิดซ้ำในความผิดเกี่ยวกับเพศหรือที่ใช้ความรุนแรง พ.ศ. 2565 ใช้บังคับ แต่กฎหมายไม่เปิดโอกาสให้ชุมชนเข้ามามีส่วนร่วมในการป้องกันการกระทำผิดซ้ำ และยังไม่มีมาตรการการสงเคราะห์ภายหลังปล่อย อันเป็นการออกแบบกฎหมายที่ไม่สอดคล้องกับทฤษฎีการแก้ไขฟื้นฟูโดยรัฐร่วมกับชุมชนที่ใช้ในสากล วัตถุประสงค์ของการวิจัย: เพื่อศึกษาและวิเคราะห์ข้อจำกัดและอุปสรรคทางกฎหมายในการส่งเสริมการมีส่วนร่วมของชุมชนในการป้องกันการทำผิดซ้ำ ระเบียบวิธีวิจัย: การศึกษาครั้งนี้ใช้วิธีวิจัยเชิงคุณภาพด้วยการศึกษาเอกสาร และการวิเคราะห์เชิงเนื้อหาแบบพรรณนาความ ผลการวิจัย: พบว่า ทฤษฎีการแก้ไขฟื้นฟูโดยรัฐร่วมกับชุมชน จัดวางรูปแบบการป้องกันการกระทำผิดซ้ำผ่านมาตรการคู่ขนาน ใน 3 มิติ ได้แก่ มิติการแก้ไขฟื้นฟู มิติการป้องกันการทำผิดซ้ำ และมิติการสงเคราะห์ภายหลังปล่อย โดยในทุกมิติจะต้องส่งเสริมให้ชุมชนเข้ามามีส่วนร่วม ซึ่งสหรัฐอเมริกาและสหราชอาณาจักรได้นำไปปรับใช้ในการออกแบบกฎหมาย ทำให้มาตรการป้องกันการทำผิดซ้ำมีประสิทธิภาพสูง สรุป: งานวิจัยนี้ชี้ให้เห็นว่า พระราชบัญญัติมาตรการป้องกันการกระทำความผิดซ้ำในความผิดเกี่ยวกับเพศหรือที่ใช้ความรุนแรง พ.ศ. 2565 ควรแก้ไขเพิ่มเติมบทบัญญัติในส่วนของมาตรการการป้องกันการกระทำผิดซ้ำและการสงเคราะห์ภายหลังปล่อย ด้วยการเปิดโอกาสและสนับสนุนให้ชุมชนเข้ามามีส่วนร่วมตามรูปแบบทฤษฎีการแก้ไขฟื้นฟูโดยรัฐร่วมกับชุมชน
