ปัญญาประดิษฐ์ทางการแพทย์กับกฎหมายเครื่องมือแพทย์ของไทย: ข้อจำกัดของพระราชบัญญัติเครื่องมือแพทย์ พ.ศ. 2551 ที่มีอิทธิพลต่อการตัดสินใจของแพทย์

บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาขอบเขตของพระราชบัญญัติเครื่องมือแพทย์ พ.ศ. 2551และที่แก้ไขเพิ่มเติมโดยพระราชบัญญัติเครื่องมือแพทย์ (ฉบับที่ 2) พ.ศ. 2562 ในการกำกับซอฟต์แวร์และปัญญาประดิษฐ์ทางการแพทย์ 2) วิเคราะห์แนวทางของสำนักงานคณะกรรมการอาหารและยาเกี่ยวกับซอฟต์แวร์ที่เป็นเครื่องมือแพทย์ (Software as a Medical Device: SaMD) ฉบับเดือนมิถุนายนและฉบับปรับปรุงเดือนตุลาคม พ.ศ. 2567 3) ประเมินข้อจำกัดของกฎหมายเมื่อระบบปัญญาประดิษฐ์มีผลโดยตรงต่อการตัดสินใจของแพทย์ 4) เปรียบเทียบแนวทางของสหภาพยุโรปตามระเบียบ (EU) 2024/1689 และแนวทางขององค์การอาหารและยาสหรัฐอเมริกา เพื่อเสนอแนวทางพัฒนาการกำกับดูแล การวิจัยนี้เป็นการวิจัยเอกสารทางกฎหมาย ใช้วิธีตีความตัวบท วิธีตีความตามวัตถุประสงค์การวิเคราะห์เปรียบเทียบกฎหมายเชิงพรรณนา
ผลการวิจัยพบว่า 1) กฎหมายไทยมีฐานรับรองซอฟต์แวร์และปัญญาประดิษฐ์บางประเภทเป็นเครื่องมือแพทย์ เพราะนิยามตามมาตรา 4 รวม "ผลิตภัณฑ์ ซอฟต์แวร์ หรือวัตถุอื่นใด" และผูกสถานะกับวัตถุประสงค์ทางการแพทย์ 2) แนวทางของสำนักงานคณะกรรมการอาหารและยาครอบคลุมการคัดกรอง การจัดระดับความเสี่ยง การขึ้นทะเบียน และการแก้ไขเปลี่ยนแปลงซอฟต์แวร์ที่เป็นเครื่องมือแพทย์อย่างเป็นระบบ 3) กรอบดังกล่าวยังมีข้อจำกัดเมื่อปัญญาประดิษฐ์มีอิทธิพลต่อดุลพินิจ
ทางการแพทย์โดยเฉพาะการกำกับดูแลโดยมนุษย์ ความโปร่งใส คุณภาพและอคติของชุดข้อมูลการติดตามสมรรถนะหลังออกสู่ตลาด และการจัดสรรความรับผิดในห่วงโซ่การพัฒนาและใช้งาน
4) บทเรียนจากกฎหมายเปรียบเทียบยืนยันว่าควรพิจารณาทั้งลักษณะผลิตภัณฑ์และผลกระทบของระบบต่อมนุษย์
บทความเสนอว่าควรพัฒนาแนวทางสำหรับปัญญาประดิษฐ์ทางการแพทย์ความเสี่ยงสูงบนฐานกฎหมายเดิม โดยเพิ่มเกณฑ์เรื่องระดับอิทธิพลต่อการตัดสินใจทางการแพทย์และการกำกับตลอดวงจรชีวิตของระบบ
