อุปสรรคทางกฎหมายเกี่ยวกับการค้าบุหรี่ไฟฟ้าของประเทศไทย

บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อ 1) เพื่อศึกษาอุปสรรคทางกฎหมาย แนวคิดและทฤษฎีของกฎหมายเกี่ยวกับอุปสรรคในการนำเข้าส่งออก จำหน่าย การควบคุมฉลากหีบห่อบุหรี่ไฟฟ้าในทางการค้า 2) เพื่อเปรียบเทียบความเหมาะสมของประเทศไทยในการใช้กฎหมายเกี่ยวกับบุหรี่ไฟฟ้าในทางการค้า กับ Smokefree Environments and Regulated Products Act 1990 ของประเทศนิวซีแลนด์ และ Republic Act No. 11900 ของประเทศฟิลิปปินส์ 3) เพื่อเสนอแนะแนวทางในการปรับปรุงแก้ไขกฎหมายของประเทศไทย เพื่อส่งเสริมการค้าบุหรี่ไฟฟ้าอย่างมีประสิทธิภาพ อย่างไรก็ตาม วิจัยฉบับนี้เป็นวิจับเชิงคุณภาพโดยศึกษาจากเอกสาร ได้แก่ หนังสือ ตำรา วารสาร บทความทางวิชาการ รวมถึงบทความของส่วนราชการและหน่วยงานต่างๆ เอกสารข้อมูลบนสื่ออิเล็กทรอนิกส์ไม่ว่าจะเป็นเอกสารในประเทศหรือต่างประเทศ จากการวิจัยผู้วิจัยพบว่า ปัจจุบันประเทศไทยยังไม่มีมาตรการทางกฎหมายที่ครอบคลุมและสอดคล้องกับพฤติกรรมผู้บริโภคเกี่ยวกับบุหรี่ไฟฟ้า ซึ่งยังถือเป็นสินค้าผิดกฎหมายและมีการลักลอบจำหน่ายโดยไม่ได้รับอนุญาตตามกฎหมาย อีกทั้งยังไม่มีการควบคุมบรรจุภัณฑ์อย่างชัดเจน และหลักเกณฑ์ที่ขัดกันในเรื่องของคำนิยามบุหรี่ไฟฟ้า พร้อมทั้งเรื่องรูปแบบของผลิตภัณฑ์บุหรี่ไฟฟ้า ส่งผลให้เกิดอุปสรรคในการค้าบุหรี่ไฟฟ้าและการคุ้มครองผู้บริโภคบุหรี่ไฟฟ้า จึงควรมีการศึกษาหาแนวทางแก้ไขเพื่อปรับปรุงกฎหมายให้สอดคล้องกับสถานการณ์ปัจจุบันเพื่อลดอุปสรรคในทางการค้าบุหรี่ไฟฟ้าและเกิดประโยชน์สูงสุดต่อผู้บริโภคบุหรี่ไฟฟ้าในประเทศไทย
