การศึกษาครั้งนี้มีวัตถุประสงค์ เพื่อศึกษาคำวินิจฉัยของศาลรัฐธรรมนูญที่มีต่อการพัฒนาการเมืองไทยด้วยวิธีการศึกษาคำวินิจฉัยของศาลรัฐธรรมนูญและการสัมภาษณ์ผู้ให้ข้อมูลสำคัญเป็นการเฉพาะเจาะจง ตามที่ได้สอบถามความเห็นจากกลุ่มตัวอย่างแบบเจาะจงจากการสัมภาษณ์แบบเจาะลึกจาก ผู้ที่เกี่ยวข้องในการวินิจฉัยคดีของศาลรัฐธรรมนูญ ซึ่งประกอบด้วยบุคคล 3 กลุ่ม ได้แก่ กลุ่มที่ 1 ประธานศาลรัฐธรรมนูญ และตุลาการศาลรัฐธรรมนูญ รวม 8 คน กลุ่มที่ 2 ที่ปรึกษาประธานศาลรัฐธรรมนูญ ที่ปรึกษาตุลาการศาลรัฐธรรมนูญ ผู้เชี่ยวชาญประจำประธานศาลรัฐธรรมนูญ ผู้เชี่ยวชาญประจำตุลาการศาลรัฐธรรมนูญ รวม 25 คน และกลุ่มที่ 3 เลขาธิการสำนักงานศาลรัฐธรรมนูญ ที่ปรึกษาสำนักงานศาลรัฐธรรมนูญ รองเลขาธิการสำนักงานศาลรัฐธรรมนูญ ผู้เชี่ยวชาญด้านคดี และวิชาการสำนักงานศาลรัฐธรรมนูญ รวม 16 คน ผลการศึกษาพบว่า คำวินิจฉัยของศาลรัฐธรรมนูญที่มีต่อการพัฒนาการเมืองไทย แบ่งได้ดังนี้ 1) คำวินิจฉัยของศาลรัฐธรรมนูญที่เกี่ยวกับการสร้างความเป็นสถาบันของพรรคการเมืองไทย 2) การสร้างระบอบรัฐธรรมนูญนิยมและหลักนิติรัฐ 3) คำวินิจฉัยในการตรวจสอบการทำหน้าที่ของฝ่ายบริหาร                     4) คำวินิจฉัยศาลรัฐธรรมนูญในเรื่องของการตรวจสอบการใช้อำนาจของรัฐ 5) คำวินิจฉัยของศาลรัฐธรรมนูญในเรื่องถอดถอนจากตำแหน่ง 6) คำวินิจฉัยของศาลรัฐธรรมนูญในเรื่องบทเฉพาะกาล

ABSTRACT

          This study aims to study the decision of the constitutional court toward Thai’s political development. The research methodology used based on in-depth interview from 3 groups of key, informants involved in the decision of the constitutional court.  Group 1 consisted of Chairman of the Constitutional Court And judges of the Constitutional Court included 8 key people. Group 2 consisted of President of the Constitutional Court consultancy, Advisor Judicial Court, Experts of the President of the Constitutional Court, Expert judge of the Constitutional Court included 25 people and group 3 consisted of Secretary General of the Constitutional Court, Advisor to the Office of the Constitutional Court, Deputy Secretary General of the Constitutional Court, Office of the Constitutional Court ruling and academic experts 16 people. According to the study, The decision of the Constitutional Court of Thailand affecting political development. Categorized as follows 1) The decision of the Constitutional Court regarding the creation of an Institute of Political Thailand. 2) Creating a constitutional and legal state. 3) The decision is to examine function of the executive. 4) The decision of the Constitutional Court as the matter of monitoring the using power by state. 5) The decision of the Constitutional Court in removal politician form position. 6) The decision of the Constitutional Court pertains to the transition provision.
