LEGAL PROBLEMS REGARDING THE APPOINTMENT OF LAWYERS FOR CRIMINAL DEFENDANTS IN COURT

Abstract
The aims of this research were to 1) study legal problems toward the appointment of lawyers for criminal defendant with imprisonment sentence in court and 2) study legal problems toward the appointment of lawyers for criminal defendant with fine in court. The research only studied legal issue toward appointment of lawyers for criminal defendant in Section 173 under Criminal Procedure Code of Thailand. This was qualitative research. The study carried out by documentary research and in-depth interview. Data were gathered by means of questionnaires and interviews with 24 samples. All respondents were involved in the criminal justice system.
It found that; 1) criminal case with imprisonment sentence, before trial, the courts are permitted to ask the need of lawyer for criminal defendants. Nonetheless, the law does not require the court to immediately appoint a lawyer for the defendant without asking. If the criminal defendant does not understand law and denies a lawyer, and the criminal defendant is prosecuted without appointment of lawyer and providing legal assistance. The group samples said that it will have more disadvantages for criminal defendants than advantages. 2) Criminal case with fine, before trial, there is no law to specify the courts in asking appointment of lawyer for criminal defendant. If criminal defendant is prosecuted without appointment of lawyer and providing legal assistance, the group samples said that it will be more unbeneficial for criminal defendants than beneficial. The researcher recommends to improve the Criminal Procedure Code, Section 173, paragraph two. In criminal case with imprisonment, the courts can immediately exercise power to appoint lawyer when the defendant does not have a lawyer. Similarly, criminal case with fine shall be amended. The court must immediately appoint a lawyer to defendants when defendants do not have lawyers.
