Abstract

This qualitative research is to examine the development of Thailand’s harmful content regulation to protect minors in TV services and to find out a plausible regulatory model and policy recommendations on improving its regulatory approach in line with media convergence by conducting document analysis, focus group discussion and in-depth interview of three stakeholder groups in Thailand’s media circle including broadcasting regulators, activists on youth and media from civil society and academics, and current Thai TV providers. The research found that the 1st phase of Thailand’s harmful content regulation (1997-2011) focuses on self-regulation with informative regulatory approach and statutory regulation with positive content approach; then the 2nd phase (2011-present) changes the focus to statutory regulation by NBTC with informative, restrictive, and positive content regulatory approach. Limitations in harmful content regulation in TV services include ineffective enforcing mechanism of both statutory and self-regulation, inadequacy in policy advocacy, and some challenges from media convergence toward TV regulatory framework and tools.
The research proposed some key recommendation for improving in protecting minors against harmful TV content under convergence in Thailand: implementing multi-stakeholderism, initiating a national convergent communication policy to protect minors covering with the promotion of media education and advocacy, and shifting toward co-regulation in TV services under the NBTC’s jurisdiction.
