Administrative Cases Involving Teachers and Educational Personnel under the Office of the Basic Education Commission

Abstract

          This research examines the orders and judgments of the Supreme Administrative Court concerning teachers and educational personnel under the Office of the Basic Education Commission (OBEC) from 2014 to 2022 (2557-2565 B.E.). The study aims to analyze litigation conditions, case types, and trends in administrative cases, and to provide guidelines for good governance to improve and strengthen OBEC personnel and agencies. The data collected from the interview was analyzed using content analysis.  
               The research found that from 2014 to 2022, OBEC had 1,818 cases filed with the Administrative Court of First Instance. Among these, 209 decisions involved teachers and educational personnel. In these cases, OBEC was the defendant in 177 rulings, representing 86.68% of the decisions. Conversely, OBEC was the plaintiff in 32 decisions, accounting for 15.31%. The findings indicate a growing trend of teachers and educational personnel filing lawsuits against OBEC, reflecting that personnel and agencies under OBEC lack expertise in the main laws and specific laws necessary for good government performance. Therefore, continuous knowledge management and legal education are essential for OBEC to establish an appropriate work system and reduce the problem of bringing cases to the Administrative Court.
