Implementation of Alternative Justice Policies Through Dispute Mediation

Abstract

          This paper aims to present a model for the implementation of alternative justice policies by means of mediating disputes and report problems and obstacles in the practice of dispute resolution that affect the success of the implementation of the mediation policy. In order for the practitioners to bring the policy into practice with greater success than failure, the problems with the implementation of the process must be resolved because the practitioner may lack knowledge, skills and techniques in mediation. Also, technological tools may not appropriate and inadequate for the current situations. Therefore, the promotion of mediation in all dimensions must be accelerated, and a network of cooperation in related processes or organizations should be created and mediation in all forms at all stages before filing a lawsuit or after filing a lawsuit and in all courts should be disseminated to allow parties and people to access dispute mediation services. In addition, Practitioners should have a clear working style, perform duties effectively and achieve results in accordance with the goals of the Office of the Court of Justice's policy.
