Abolition of the Death Penalty for Arson

Abstract

This research consists purposes were 1. to study the concepts, theories, principles, background and measures related to capital punishment for the crime of arson 2. to Comparative study of the laws of Thailand with those of the Federal Republic of Germany and the United States regarding the death penalty for the crime of arson 3. to Analyze the legal problems of the legal measures for the death penalty for the crime of arson according to Thai law compared with the laws of the Federal Republic of Germany and the United States of America and 4. to Study and find solutions and develop appropriate punishment methods for the crime of arson. This is a qualitative study employing documentary research methods using relevant sources such as legal textbooks, academic articles, journals, research papers, theses, study reports and Acts. The information collected from these related documents was then analyzed using content analysis. The findings revealed that 1) Human rights principles guarantee protection for individuals against torture or cruel, inhuman or degrading treatment or punishment or it cannot trample on human dignity. The death penalty is the most severe punishment and can only be carried out in the most heinous cases 2) The Federal Republic of Germany and the United States have principles of appropriate and proportionate punishment for the crime of arson 3) Thai law has been found to have problems in determining the punishment for the offence of arson under Section 218 of the Criminal Code and 4) Improve and develop the law on arson, such as in the Federal Republic of Germany and the United States and amend Section 218 of the Criminal Code to be appropriate for the changing social conditions.
