Abstract

This academic consists purposes 1. to study the legal rights of independent delivery drivers or riders and their labor protection and 2. to analyze and recommend legal rights of independent delivery drivers or riders and their labor protection. Currently, there are platforms providing services with a large number of riders in the labor system, but these riders are interpreted as independent professionals who are not protected by labor law. This academic article reviews literature related to the development of legal measures for serious juvenile offenses, including textbooks, laws, research reports, journal articles, seminar documents, articles, and electronic media books. The study found that 1) Because Thai labor law stipulates that protection must be consistent with employment status, which currently divides employment into two forms: employee and independent contractor, riders face challenges in being classified as self-employed. This definition of status does not reflect their actual working conditions. Riders are often referred to as partners of employer platforms or lumped together as independent workers, despite their work characteristics being similar to employees or sometimes with working conditions that fall between employers and employees and 2) Enacting appropriate labor protection laws will significantly improve the quality of life of riders and independent workers. Promoting comprehensive labor protection for riders and independent workers under labor law will foster equality in rights and protection, a fundamental right that all workers should receive. This will be achieved through proper registration under labor law. Furthermore, it will support the draft of the Independent Workers Promotion and Protection Act, B.E. ..., which will guarantee and benefit riders and independent workers.
