Abstract

This research consists purposes were 1. to study concepts, theories, and principles related to legal issues in the performance of duties of local government organizations and Provincial Administration 2. to study legal issues in the performance of duties of local government organizations and provincial administrations 3. to study and compare laws related to the scope and authority of local government organizations and provincial administrations and 4. to analyze and determine guidelines for solving legal issues in the performance of duties of local government organizations and Provincial Administrations. is a qualitative research study conducted through a review of relevant documents, with the collected information analyzed using content analysis. The research findings revealed 1) Key concepts, theories and principles in local and area administration. It was found that key concepts, theories, and principles in legal issues in the performance of duties of local government organizations and provincial administrations are the principle of decentralization, concepts regarding local government organizations, concepts or laws regarding provincial administrations, principles of promoting public participation, transparent services, and strong supervision. These will help local government organizations' operations align with the needs of the people and lead to balanced and comprehensive national development in the long term 2) Legal issues in the implementation of the duties of local government organizations and provincial administrations revealed overlapping authority and responsibility between local government organizations and provincial administrations. This is evident in several missions, such as education, public health, and disaster prevention, where there is no clear identification of primary responsibility. This causes delays and inability to respond to the public in a timely manner, especially in emergency situations 3) A comparison of the legal authority for the implementation of duties between local government organizations and provincial administrations reveals unclear authority, centralized control, imbalanced transfer of duties relative to available resources, and continued interference in local politics and 4) The structure for resolving legal issues in the implementation of the duties of local government organizations and provincial administrations addresses five areas: unclear authority and responsibility between local government organizations and provincial administrations, and transfer of duties between local government organizations and provincial administrations. The structure of local government organizations and provincial administrations, the personnel of local government organizations and provincial administrations, and the overlapping of the scope and authority of local government organizations and provincial administrations.
