Guidelines for Enhancing the Efficiency of Legal Proceedings in Online Shopping Fraud Cases in Thailand: A Case Study of the Legal Proceedings Conducted by the Technology Crime Suppression Division (TCSD)

This research consists purposes were 1. to study the problems and procedures for prosecuting fraud arising from online product sales in Thailand 2. to examine the obstacles to prosecuting fraud arising from online product sales faced by the Technology Crime Suppression Division and 3. to propose guidelines for enhancing the efficiency of prosecuting fraud arising from online product sales in Thailand by the Technology Crime Suppression Division. This is a qualitative research study. The research instruments include a semi-structured interview form, an observation form and a recording form. The target group consists of six individuals selected through purposive sampling. The data collected from documents and research instruments were analyzed using content analysis. The research results show that 1) Problems and methods of prosecuting online sales fraud in Thailand Online sales fraud arises from deceptive practices in selling goods, such as posting or advertising products online without actually possessing them, selling products that differ from the advertised description, or failing to deliver the goods after payment has been made 2) Problems and obstacles in prosecuting online sales fraud in Thailand faced by the Technology Crime Suppression Division 2.1) Aspect 1 Online fraud prosecution process 2.2) Aspect 2 Personnel 2.3) Aspect 3 Public awareness and dissemination of information and 3) Guidelines for enhancing the efficiency of prosecuting online sales fraud in Thailand by the Technology Crime Suppression Division 3.1) Aspect 1 Online fraud prosecution process: Improve efficiency in the investigation stage, enhance tools and techniques and integrate collaboration with relevant agencies. Agencies should revise related regulations and orders, encourage network partners to participate in management and operations with flexibility and modernity and establish systems linking databases to support network participation 3.2) Aspect 2 Personnel Provide opportunities for knowledge and experience development, increase the number of essential personnel, allocate or recruit additional officers critical to operations, ensure adequate administrative resources and adopt effective information technology systems. Implement a professional personnel management system with expertise, modern skills and technological proficiency for operational purposes 3.3) Aspect 3 Public awareness and dissemination of information Disseminate and publicize information to ensure accessibility, speed and ease of use. Organize appropriately structured communication systems, enhance public awareness campaigns and foster motivation and awareness to encourage public participation.
