The Legal Measures and The Role of NBTC in Regulating Advertising Content on The Internet

This Academic consists purposes were 1. to study the concept, theory, rights of service users, supervision and organizations in supervising the content of advertising programs on the Internet 2. to study and compare legal measures in supervision and organizations in supervising the content of advertising programs on the Internet
in Thailand and abroad 3. to analyze legal problems in supervision and organizations in supervising the content of advertising programs on the Internet in Thailand and 4. to present legal measures and roles of organizations in supervising the content of advertising programs on the Internet that are appropriate for Thailand. Currently, providing digital platform services or services in the form of OVER-THE-TOP (OTT) is widely popular because it allows access to content (Content) or advertising (Advertising) via the Internet at any time and any place, regardless of the age of the user. However, such services may be an act that takes advantage of users and still lack clear legal measures. Although this service is similar to broadcasting and television businesses, which are under the Frequency Allocation Act B.E. 2553, the NBTC has not yet been clearly and sufficiently stipulated in its power and duty to supervise such services. While countries such as the European Union, the United Kingdom, and Singapore have put in place comprehensive new regulatory measures for OTT businesses, focusing on controlling inappropriate content or advertising, rating appropriateness of content, and protecting children and young people, as well as imposing legal penalties on service providers who violate or fail to comply, it is therefore appropriate to amend the relevant laws so that regulatory bodies such as the NBTC have a clear role and authority, including drafting appropriate legislation or announcements to effectively regulate OTT businesses and keep up with changes in technology.
