Preventive Measures Against Deceiving the Elderly to Enter a Juristic Act.

Abstract

This research consists purposes were 1) to study forms of manipulation of the elderly in order to accomplish a legal act and 2) to propose legal measures to prevent manipulative acts towards the elderly. This qualitative research with an interview form as a research tool was carried out on the target group of 24 persons including 14 deceived people and 10 government officers, namely the elderly’s guardians, a police officer, a judge, prosecuting attorneys, and academics, all of whom were working in Khon Kaen. The target group was specifically selected.  The data from documentary research and the interview form were verified and analyzed by triangulation. The research findings were as following 1) Most deceived people in both urban and rural areas have average and good economic status. The frauds could be classified into 2 categories; 1.1) persuading the elderly to enter the juristic acts in the real area of the research, 1.2) persuading the elderly to enter the juristic acts virtually through online systems. and 2) The preventing will include civil and criminal as well as social measures; 2.1) civil measures by appointing an asset guardian, 2.2) criminal measures by increasing fine and imprisonment sentences and 2.3) social measures by encouraging organization and community’s participation.
