Abstract

This research consists purposes to study mediation cultures of Thai-Lao ethnic groups in the northeastern region of Kingdom of Thailand and Lao People’s Democratice Republic (Lao PDR). is qualitative research. There are research tools, namely interview forms, with research target groups. A total of 15 people came from a specific selection. They are divided into 2 groups: 1) Thai target groups consist of monks, virtuous people, community leaders, court personnel or related persons. Civil case parties, lawyers, 8 people, and the target group of Lao PDR, 7 people, consisting of personnel in Ta Saeng (sub-district chief) and people in the village free from cases. and then use the information gathered from various related documents and from the interview to content analysis. The results were found that the mediation culture means growth process of law in justice or peaceful settlement between litigant parties under stimulation or win-win strategy by the third party or mediator, who use the mercy and kindness beng the heart of mediation. With these reasons, the disputes in both civil and criminal cases would be peaceful solved by changing from enemy to friend. Communities would live happily by using Buddhist as the principle of judgement, and the litigants were afraid of sin. Then, both civil and criminal cases were decreased. Houses or families and fiver-precept-cultural villages have created the communities having growths in health, mindness and body. Five-precept village plan would create the five-precept villages of local administration organization being able to mediate the law cases efficiently without cases and with happiness because villagers trust village leaders. The village leaders promote everyone performing in good cultures, which causes the community peacefully since grassroots. These can cease problems and mediate the mediations since the causes of problems. Society and nation would then were flourish.
