Legal Problem of Collection of Wastewater treatment service Fees in Local Government Organizations.

The purposes of this study were 1. to study concepts and principles of law governing the local government organization to collect wastewater service fees 2. study the law on wastewater management abroad to be used as a solution to Thailand's problems. 3. analyze the problem of Wastewater treatment Fees collection of the Local government Organization of Thailand and 4. provide guidance on the amendment of the law in setting the wastewater treatment service rates of Local government Organizations in Thailand. To be able to collect the cost of their own local wastewater treatment service effectively. This research is a legal research with a qualitative research method by studying documentary research by collecting information from the law.Then the data were analyzed in a content analysis. The study revealed that 1) The concept and principle of collection of wastewater treatment service fees of Thailand’s Local government Organizations under the Enhancement and Conservation of National Environmental Quality Act, B.E. 2535, collection of wastewater treatment service fees can be under the principles stipulated by law, together with the Polluter Pays Principle (PPP). 2) The laws on wastewater management of Japan, Singapore and Malaysia revealed that there are specific laws on the provision of sewerage and wastewater treatment systems, the law that giving power of state organizations to directly collect wastewater treatment services, and wastewater treatment service rates are set in the same rates throughout the country. And in Indonesia has specific law on wastewater management, the law that giving power of state organizations to directly collect wastewater treatment services, but rate of wastewater treatment fees have set by each local government organization. 3) Collection of wastewater treatment service of Local government Organizations of Thailand. There is a main law giving power, is the Enhancement and Conservation of National Environmental Quality Act, B.E. 2535, but there are conditions, budget for the construction of the wastewater treatment system must be partially or fully supported by The Environmental Fund. Collection of wastewater treatment fees in Pattaya City, it was found that some provisions setting the wastewater treatment rates contrary to the announcement of the National Environment Board. The collection of wastewater treatment services in Bangkok Metropolitan Administration, it was found that the provisions of the wastewater treatment fees could not be enforced. For the other types of Local government Organizations revealed that the laws provide provisions for the Local government Organization to have a duty to manage wastewater but does not provide the authority to collect wastewater treatment fees directly. And 4) The author suggested revisions to some provisions of the Enhancement and Conservation of National Environmental Quality Act, B.E. 2535, including Section 73, 88 and 93. To expedite the issuance of a central law on wastewater management.
