Abstract

This academic article Want to present legal measure to control and protect dust pollution or PM2.5, 2. to analyze legal procedures to control and protect dust pollution or PM2.5. This research found that living and health of Thai people were affected by the dust pollution. For the last few years, the effect of dust pollution continued to occur severely in every part of Thailand, especially dry season, during December to April. Source of the dust pollution affected people’s living and health the most was burning in agricultural areas. The burning increased continuously because the advancement of agricultural industry, burning in mountain area and agricultural management of neighbor countries. Therefore, every part of Thailand had PM2.5 problems. To enforce various laws presently need to prove and collect relevant laws in order to apply the laws seriously, for example, Promotion and Conservation of National Environmental Quality Act, B.E. 2535 has legislative act on pollution control which mentions that it should have an announcement to determine organizations to do an analytical report concerning environmental and health impact. The report should have a measure for protection and follow up environmental impact, such as dust and air pollution protection and identify a measure for protection also. In Thailand, the legal measure for this issue is separated in many acts. Each act contains different purposes to manage specific issues but not related with PM2.5 management specifically. As a result, the enforcement of the law for PM2.5 management is still ineffective. If there is a section working under the law to protect and manage PM2.5 problems clearly and follow up the results continuously, the problem of PM2.5 will be reduced and resolved.
