Legal Issues on the Protection of Rights and Freedoms of Children Passengers Motorcycles under the Land Traffic Act B.E.2522

This research consists purposes were 1. to Study the concept, theory and principle of the law on the protection of rights and freedom of children riding motorcycles according to the Land Traffic Act B.E. 2522 2. to Study and compare the provisions related to the law on the protection of rights and freedom of children riding motorcycles according to the Land Traffic Act B.E. 2522 of Thailand with foreign laws 3. to Study and analyze the problems of legal measures related to the protection of rights and freedom of children riding motorcycles according to the Land Traffic Act B.E. 2522 and 4. to Study the recommendations for the development and improvement of the law on the protection of rights and freedom of children riding motorcycles B.E. 2522 to be effective according to international standards. This is a qualitative research conducted using the documentary research method. Data were collected through the review and compilation of relevant sources, including legal textbooks, theses, research studies, articles, websites, statutes and electronic information related to both Thailand and foreign countries. The collected documents were then analyzed using content analysis. The research results found that 1) The concept, theory and principle of the law on the protection of rights and freedom of children riding motorcycles according to the Land Traffic Act B.E. 2522 focuses on the rights and freedom of children. And stipulate that the provisions in the traffic law have the condition of enforcing punishment for drivers 2) When studying the laws of Thailand and foreign countries, it appears that the traffic law of Thailand still does not have legal measures to determine the appropriate age of children and sufficient safety equipment for riding motorcycles. This is different from the laws of foreign countries that have specified the appropriate age of children and additional child safety equipment from the existing Thai law for riding motorcycles. Including stipulating that the provisions in the traffic law regarding the age requirements and child safety equipment have the condition of enforcing punishment for drivers who violate, which has a significant impact on the rights and freedoms of children riding motorcycles 3) The law to protect the rights and freedoms of children riding motorcycles according to the Land Traffic Act B.E. 2522, the traffic law of Thailand still does not have legal measures to determine the appropriate age of children and sufficient child safety equipment for riding motorcycles, including stipulating that the provisions in the traffic law regarding the age requirements and child safety equipment for riding motorcycles have the condition of enforcing punishment for drivers who violate and 4) Propose amending the Land Traffic Act B.E. 2522 to enact a specific law for the appropriate age of children and additional safety equipment for riding motorcycles, including stipulating that the provisions in the traffic law regarding the age requirements and child safety equipment for riding motorcycles, which have been specifically specified, have the condition of enforcing punishment for drivers who violate, effectively in accordance with international standards.
