Abstract

This academic consists purposes is to study the provisions concerning the prescription of Thai criminal cases since the provisions concerning the prescription of criminal cases have been enacted for a long time. And it is not in line with the changing social conditions and wants to reduce the impact on the delayed Thai justice process. and legal gaps This research also focuses on the problem of prescription age in criminal cases. by studying the prescription of offenses that do not have a prescription limitation Offenses that can be extended Offenses that cause the prescription to be interrupted the study found that age provisions are very important in the justice process because the state has a duty to bring offenders to trial. for reasons for determining the age, it was found that for fairness and certainty in litigation for reasons of evidence may be lost. The more time passes, the more the memory of a witness decreases. But if considering the current situation, the offender has fled the country so that he is not imprisoned and cannot be brought back for trial That age still has to go on. by waiting until the deadline If Thailand takes decisive measures and does not allow the perpetrators to flee, it will be beneficial for the arrest of the perpetrators to be punished. It will result in a better Thai justice system. However, from the study, it was found that the stipulation to stop counting the prescription for cases an escaped offender, regardless of any stage of escape, will greatly solve the judicial problem and should be prescribed in all offenses, and the escape of the offender can be considered that the offender waives the right to be Get a quick and fair trial This will result in the offender not being able to use the legal channels regarding the prescription for their own benefit. It is also good for the Thai justice process.
