Model Law on the Status Recognition and Protection Rigth and Duties of Gender.

Abstract

This research consists purposes were 1. study and analyze gender situation in Thai society 2. study and analyze international public law and foreign law on status recognition and protection, rights and duties of gender under human rights regulations 3. proceed model law on status recognition and protection, rights and duties of gender. This study was a qualitative research including documentary research and in-depth interview with 16 research participants. The data from in-depth interview were analyzed to establish model law, and stakeholder directly had engagement with participatory design and co-design and hearing.This study presents the following results 1) The acceptance of gender identity in Thai society is considered from ability, career, economic and social status and status recognition by law 2) Foreign law is considered that gender identity has the same rights as male and female, and they should receive equal protection under regulations of international public law and foreign law. The law of status recognition will provide protection and the rights for transgender without contraction with human rights legislated on Thai Constitution 3) The model law on status recognition and protection, rights and duties of gender has structure of the law including general chapter, qualification of transgender, procedure for gender recognition, procedure for transgender, rights and duties of gender and responsibilities of transgender. This research provides the following suggestions. The model law of gender status recognition should be considered by legislative process, and publicized to a group of transgender The process of publicity should be organized by human right and protection organization. After the process, the law will be proposed to the human right committees to push and manage the model law functionalize personal protection for transgender obviously and concretely.
