Determination of Suitable Criminal Punishment in Relation to the offence of Sexual Intercourse in Thailand.

Abstract

This research consists purposes were to 1. to study the penalty rate prescribed by Thai law Penalty Comparison in the offense of rape of Japanese’s law, Lao People's Democratic Republic, France, German, federation, and Cambodia to analyze interpret and find recommendations for the offenses and 2) to study the guidelines for revising and correcting Penalty rates for offenses related to rape according to the criminal code. This research is a qualitative research using a documentary research method. By studying the criminal code of Thailand. Japanese criminal law Lao People's Democratic Republic France german federation and Cambodia, articles, journals, academic documents, research papers, dissertations and information from internet networks both in Thailand and abroad. The information gathered from documents were then content analysis. The results of the study found that 1) A comparative study found that Japan Lao People's Democratic Republic France German federation and Cambodia has set the rate of punishment for the offense of rape lower penalty rate than Thailand Whether it is a minimum penalty rate with a lighter penalty or a higher penalty rate that is lighter both in some cases Still, the minimum prison sentence is substantially lower than Thailand's law. make the courts of that country able to exercise discretion in determining the rate of punishment to be appropriate for the commission of such offense This is especially true in cases where rape causes death. Thai law stipulates only two penalties: life imprisonment and execution which is different from other countries that still maintain a minimum sentence of imprisonment and 2) It should be amended to increase the minimum penalty rate. in sexual offenses on various bases so that the court can exercise its discretion and punish appropriately with the actual action.
