Abstract

This research consists purposes were 1. to study and analyze problems faced by forensic evidence in the criminal trials of Thai courts and 2. to study the appropriate approach to solving problems related to forensic science expert witnesses in the criminal trials of Thai courts. This is a qualitative research By studying from various related information documents such as electronic media, legal textbooks, legal articles, articles, academic journals, thesis and research, then the collected data is content analysis The results showed that 1) The study analyzes the problems faced by forensic evidence in the criminal trials of the Thai courts, consisting of 1.1) problems in hearing and weighing expert witnesses 1.2) problems in the process and methods in choosing to listen to expert witnesses 1.3) problems in examination Examination of expert witnesses 1.4) Problems protecting expert witnesses 1.5) Problems accessing expert witnesses of the underprivileged and 2) a study of appropriate guidelines for solving problems related to forensic science expert witnesses in the criminal trials of the Thai courts, consisting of 2.1) problems of hearing and weighing expert witnesses, namely, the United States has established principles for the use of forensic evidence. go to court 2.2) Problems with the process and method for choosing to hear expert witnesses are that the Commonwealth of Australia, where necessary, courts can use concurrent Witness. 2.3) Concurrent Witness issues. Examine expert witnesses, namely the United States. There are several professional councils for forensic science, each subdivided into specializations. and also has a multidisciplinary professional council including other agencies or organizations that are responsible for setting standards and ethics in forensic science or an offense of defamation according to the criminal code and may be at risk of ethical complaints etiquette or professional ethics; and 2.5) the problem of access to expert witnesses of the underprivileged is that the state must come in to promote and support all people equally. for the sake of justice.
