Local Ordinance Model to Control Nuisance Problem in accordance with the Law of Public Health.

Abstract

This research consists purposes were to create a model of local ordinances for nuisance enforcement under the law on public health. and making the community have a good quality of life is a qualitative research There is a research tool, which is an interview form, with the research target group being 16 people who came from a specific selection consisting of 4 groups, namely 4 government officials and local governments, 4 academics and lawyers, business sector. 4 private persons and 4 public persons, then use the information gathered from the interview form and related documents. and from the information recorded in the group hearing forum to content analysis. The results showed that the local ordinance model to control nuisance problem in accordance with the law of Public Health is an effective process of law to control nuisance problem of local government organization. The process corresponds with notion of quality of life, theory and criteria related to nuisance event and corresponds with international law. Moreover, the ordinance is not contrast with the Constitution, the highest law. The local ordinance also concerns third party impacts. For example, affected person from nuisance event should receive the protection from law as well. The local ordinance includes 19 chapters and 7 provisions. Provision 1 is general provision. Provision 2 is nuisance problem. Provision 3 is authority of local official. Provision 4 is authority of public health official. Provision 5 is affected person from nuisances. Provision 6 is responsibility of nuisance person, and provision 7 is guilty and confession.
